California: Signal Hill, Seal Beach, Others, Adopt Bans On Medical Marijuana

A number of local cities have adopted or will soon vote on measures that would ban the sale of medical marijuana, rather than let the state take control of enforcement.

Proposals in Signal Hill, Seal Beach and Lakewood effectively ban cultivation and prohibit the operation of dispensaries or mobile delivery services. The new ordinances come ahead of a March 1 deadline that would take regulatory control away from local bodies and place it under state jurisdiction. Cities have to come up with regulations before the deadline or lose local control.

The Long Beach City Council approved a measure in December allowing cannabis deliveries but prohibiting dispensary storefronts, at least in the short term. Six months after the first delivery service begins, city staffers will report back and review associated sales tax receipts, enforcement costs and other issues.

Based on that report, the council would then decide whether four storefront dispensaries should be able to open. The council would then determine if there is enough demand for a maximum of seven dispensaries in Long Beach.

SEAL BEACH

The first proposal was a so-called "urgency ordinance" adopted by the Seal Beach City Council Monday. The measure, which bans cultivation of marijuana in all zones in the city, goes into effect immediately.

The ordinance, however, is temporary. The city will hold a public hearing on the issue Jan. 25, and will hold a final vote on the ordinance Feb. 8.

SIGNAL HILL

A new ordinance under consideration would bar growing medical marijuana in Signal Hill except by a prescription holder at their private residence for personal use, and would expand the definition of a dispensary to include cannabis delivery services.

An accompanying amendment would prohibit dispensaries and delivery citywide.

The measures were introduced at a public hearing Tuesday, and will come back to the council Jan. 26 for second reading and a final vote.

At the same time, a group called Signal Hill Patients Access PAC is collecting signatures for a potential ballot measure that would allow dispensaries in all zoning districts except residential, with a 600-foot buffer for schools. It also would allow smoking and ingesting marijuana at the dispensaries.

LAKEWOOD

The Lakewood City Council on Tuesday approved an ordinance banning cultivation of medical marijuana, operating of dispensaries, and any associated activities like storing, transporting or delivering cannabis or its derivatives.

These cities, and many others across the state, are scrambling to adopt their own rules in response to language included in a trio of medical marijuana bills signed by Gov. Jerry Brown last fall.

Several of the bill's authors, however, proposed an emergency amendment to the law Jan. 6 that they are hoping the governor will sign this month. The amendment eliminates the provision about losing local control, as well as the March 1 deadline.
