City Officials Tackle Medical Marijuana Issue

The issue of licensing Medical Marijuana Caregivers came before the Sidney City Council Tuesday evening.

Voters in the state approved the Medical Marijuana Act, which decriminalized the use of marijuana for treatment of medical conditions. City attorney Gerald Navratil told the council the act was pretty broad in definition, and communities across the state are trying to deal with zoning issues related to the new law.

Since the city ordinances do not address business licenses or zoning for medical marijuana facilities, Navratil advised the council that it would be in the city's best interest to develop ordinances regarding medical marijuana caregivers. It is very likely that the state of Montana will act on the Medical Marijuana Act in January, but in the meantime, Navratil suggested the Council approve Ordinance 450, which would prohibit the growing, manufacturing, production or distribution of marijuana within the city of Sidney for 180 days.

This would allow the city attorney time to prepare the ordinances that would regulate the growing and sale of medical marijuana. The ordinance's first reading was approved by the council, and a public hearing will be scheduled soon.
