FL: Medical Marijuana Law Demystified At Council Meeting

Personal injury lawyer David Shiner knew at least four years ago that medical marijuana was coming and it would be complicated legally.

He was right. A Florida amendment was narrowly defeated two years ago, and now it's back on the ballot for a voter decision in the Nov. 8 Presidential Election.

"I started hearing the buzz," he said as the speaker at the monthly West Boca Community Council meeting in the Boca Lago clubhouse.

Shiner explained what constitutional amendment No. 2 would and wouldn't do. It would allow use of medical marijuana for people with "debilitating medical conditions" such as AIDS, HIV, ALS, PTSD, Parkinson's disease and a catchall category. It would decriminalize the patients, caregivers who assist them and licensed Florida doctors. It would only allow five grow sites. Where the dispensaries would be hasn't been decided. Doctors could not write prescriptions; that's now how it works, he said.

Medical marijuana is already legal in 23 states to some degree, but it's complicated, Shiner said. It doesn't override federal law, which still considers pot illegal. So you can't take marijuana on a plane or across states lines, he added.

"The Feds issued a white paper saying if you're in compliance with state law and not in 1,000 feet of a school," you wouldn't be prosecuted. But there's no guarantee "and a lot of restrictions are still in place," he said.
