FRESNO, Calif.–Fresno officials say one city medical marijuana dispensary is continuing to sell pot despite a Fresno County judge's ruling that such sales are not allowed.

Judge Donald Franson on Thursday made permanent an earlier decision to ban the city's nine pot shops from operating.

Deputy city attorney Michael Flores says five dispensaries reached a settlement with the city and closed, and Franson signed orders to shut down the other four.

But Flores says one shop, Medmar Clinic, is still operating, and that its owner is set to face contempt of court charges. Medmar did not immediately return a call.

Franson's ruling upheld a 2006 city zoning ordinance that requires all city businesses to meet state and federal laws.

Federal laws ban marijuana use.
