Man Pleads Guilty To Attempted Armed Robbery Of Medical Marijuana Center

DENVER - A man who was wrestled to the ground while trying to rob a medical marijuana center at gunpoint last year has pleaded guilty.

The Denver District Attorney's Office says 22-year-old James Leyva pleaded guilty to attempted aggravated robbery, menacing, illegal discharge of a firearm and two counts of being a habitual criminal. He now faces 42 years behind bars when he's sentenced in February as part of his plea deal.

Leyva was arrested in the attempted armed robbery of The Healthy Choice dispensary, located at 3005 W. Gill Pl., on Dec. 16, 2009.

Police say Leyva walked into the dispensary with his gun drawn and eventually fired at one of the employees, but the gun jammed.

Melinda Hernandez, the owner's sister, told 9NEWS last year that she leapt onto Leyva's back and refused to let go, wrestling him to the ground. A scuffle ensued and shots were fired by a second suspect.

None of the employees were injured in the attempted robbery.

Hernandez told 9NEWS the suspects were after the money, not the marijuana.
