Medical Marijuana Hearing At Earlier Time Than Reported

A public hearing on Butte County's proposed medical marijuana cultivation ordinance will begin at 9:40 a.m. today. An incorrect time was reported in Monday's newspaper.

The hearing before the Board of Supervisors will be in the administration building, 25 County Center Drive in Oroville.

The ordinance is a civil land-use measure following the county's nuisance abatement procedures. Neighbors will have to complain about a particular garden to initiate a county review of the situation.

The proposed ordinance allows for only indoor gardens on lots of one-half acre or less. It doesn't specify a specific maximum number of plants that can be grown indoors, but says the structure must be no more than 120 square feet.

On lots of more than a half-acre and less than 1.5 acres, up to six mature plants and 12 immature plants can be cultivated.

The number of plants allowed, based on acreage, tops out at 99 plants on lots of 40 acres or larger.
