Medical Pot Dispensaries' Owner Pleads To Federal Charges

A Stockton man accused of selling marijuana at storefronts in Stockton and Sacramento under the guise of supplying marijuana for medical purposes has reached a plea agreement with federal prosecutors on manufacturing and distribution charges.

Lynn Farrell Smith, 62, was a co-owner of Pathways Health Cooperative, and Port City Health and Wellness in Stockton; Central Valley Caregivers Cooperative just outside Stockton city limits; and MediZen, Sacramento Patients Group, Twelve Hour Care, River City Wellness all in Sacramento, per court records.

Smith also grew marijuana at a Stockton residence and an industrial warehouse to supply the stores, according to the plea agreement.

The U.S. Attorney's Office says Smith and co-defendants made millions in revenue from the operations which falsely claimed compliance with California medical marijuana laws.

Friday, Smith pled guilty to federal marijuana manufacturing and distribution charges, two counts of manufacturing marijuana and six counts of distributing marijuana from storefronts.

"This case is not about providing care for ill people," said U.S. Attorney Benjamin B. Wagner in a news release. "It is about the operation of a large business that grew and sold marijuana for profit. The U.S. Department of Justice has consistently stated that large-scale commercial marijuana cultivation and distribution operations will continue to be subject federal prosecution."

Several of the charges carry mandatory minimum five-year sentences. Per the plea deal, those terms will be served concurrently. The actual sentence will be determined at the court's discretion on April 5.

All the courts are screaming at us is get legal. Uncle Sam needs his cut, man. Disobeying federal laws is NOT THE SMART THING to do. Confusing the enemy......it's already complicated enough. Fighting at the ballot box is a lot less expensive anyway!
