New Medical Marijuana Dispensary Rules And Regulations For Denver

With the Colorado Department of Health and Environment receiving a record of more than 23,000 applications for Medical Marijuana cards this year, and 194 tax IDs given out to area dispensaries, Denver is wrestling with what to do with the burgeoning pot industry.

On Wednesday, December 16, 2009 the Denver city council continued deliberations and ultimately began voting on new regulations proposed by Councilman Charlie Brown.

The centerpiece of the new regulations was focused on distance issues and taxes. No dispensary shall be opened within 1000 feet of a school, child care centers or another dispensary. The new regulation also requires dispensaries to collect sales taxes.

Additionally, they would bar felons or those who have completed any portion of a felony sentence within the past five years from operating a dispensary. The new regulation would also disallow the consumption of medical marijuana on dispensary premises.

In discussing these issues with area dispensary owners, the Denver Medical Marijuana Examiner has discovered that most are in agreement with the distance from schools and child care centers, but not necessarily with each other. The perspective on felons is mixed, with most going along with the ruling in order to gain credibility.

One owner commented on the usage of pot on the premises, "I'm glad it's their (Denver's) rule actually, it's something I would have to do from a liability standpoint, but this way, they're the bad guys."

Back in the council

The council was split on when to begin the new regulations. Council members voting for the January 1st deadline were Brown, council president Jeanne Robb, Linkhart, Nevitt, Carla Madison and Marcia Johnson, while Montero, Boigon, Lopez, Hancock, Faatz and Garcia all voted for a Dec. 1st deadline. The Jan. 1st deadline was eventually adopted.

Both Doug Linkhart and Chris Nevitt were for fewer regulations on the dispensaries.

These measures will come up before the full council on Jan. 4th for consideration and a final vote on Jan. 11th

The idea of a moratorium on new dispensaries is being considered by Hancock. Denver would join Fort Collins, Loveland, Larimer County and Windsor, who already have moratoriums in place. Windsor's moratorium was just put in place on Wednesday.

If we are to glean anything from similar proceedings in California, it's that; the day after the moratorium is lifted, there will be a deluge of new applications for business licenses.
