Woodland Council Extends Medical Marijuana Moratorium

The Woodland City Council on Monday extended the moratorium on collective marijuana gardens and dispensaries another six months.

"I think it's necessary to continue the moratorium until we can figure out the conflict between the state and federal law," Mayor Grover Laseke said Monday.

Medical marijuana is legal in Washington. However, federal law makes possession illegal.

The council adopted its initial moratorium in January, hoping the Legislature would clarify legal situation, but it didn't.

Carolyn Johnson, community development planner, said the city's moratorium could be vulnerable to lawsuits by collective proponents if the city shows no effort to resolve the conflict.

Earlier this month, the council rejected a zoning proposal to control where collective gardens could be located. Some members said they were reluctant to act until voters decide on a November ballot initiative to legalize marijuana in the state.

However, others were unwilling to allow marijuana gardens and dispensaries as long as marijuana possession violates federal law.

"I'm going to have difficulty passing any ordinance (for gardens) when marijuana is a class-one substance," Councilman Benjamin Fredricks said Monday.
