ACLU To Argue Discrimination Case On Behalf Of College Student Fighting For MMj

Members of the American Civil Liberties Union are heading to court Tuesday to argue the case of a student who claims she was discriminated against for using medical marijuana.

According to Christine Callaghan, she uses medical marijuana to treat migraine headaches. In her lawsuit, she claims the Darlington Fabrics Corporation of Westerly refused to give her an internship because of her marijuana use.

Callaghan, a graduate student at the University of Rhode Island, claims the company violated her rights.

A lawyer representing Darlington Fabrics said the company is confident they complied with state and federal law.

According to the ACLU, not hiring a potential employee based on their status as a medical marijuana user “constitutes disability discrimination in violation of the RI Civil Rights Act, and also violates the medical marijuana law, which protects cardholders from discrimination in employment.”

Tuesday’s hearing is on a motion by Darlington to have the case dismissed.
