Boulder: Two Medical Marijuana Dispensaries in the Clear

Two Boulder medical marijuana dispensaries will be allowed to continue doing business after all.

The City Council on Tuesday approved a suite of technical changes to the city's medical marijuana code, including allowing two dispensaries that are operating in residential zones to stay where they are.

New Options Wellness, 2885 East Aurora Ave., and the Flower of Life Healing Arts Center, 3970 Broadway, both sit in areas that are zoned for residential use. According to the city's recently approved rules governing where and how medical marijuana businesses can operate, residential areas are strictly off limits.

The city manager said in December that she was prepared to send notices ordering both shops to shut down immediately. But the owners of the companies approached the council and asked to be exempt from the rules because they are both within planned urban development zones, which allow for mixed use, and because neither are close to residential units.

Kelly Moore, owner of the Flower of Life, which has been operating in the Lucky's Market shopping center for more than a year, said she's happy that the council backed off the plan to shutter the companies.

"The City Council was really responsive to our issue," she said. "We're all happy."

Councilman Macon Cowles previously called the situation an "anomaly that we did not intend."
