Cultivating and delivering medical marijuana is now illegal in La Verne.
The City Council voted unanimously Tuesday to replace an existing medical marijuana ban, which prohibits dispensaries from operating in the city, with one that also outlaws pot cultivation and deliveries in La Verne.
The previous ordinance, approved in 2008, only banned the operation of medical marijuana dispensaries.
"The state adopted a new rule to go into effect March 16, which relates not only to medical marijuana dispensaries but relates to the cultivation and delivery of medical marijuana," said Eric Scherer, principal planner for La Verne. "So this new ordinance basically replaces" the old one.
The La Verne Planning Commission held a public hearing Dec. 9 to discuss the proposed update and voted unanimously to recommend the City Council adopt it.
"It still continues to prohibit the dispensaries citywide, but if the city did not enact an ordinance that specifically prohibits cultivation and delivery, then the city would not be able to regulate those activities, which could be permitted through a state permit process," Scherer said.
Hal Fredericksen, community development director, said the city is among many that will be adopting similarly expanded laws based the state rule change.
"The strong potential under the new state law was for the state to be able to have control over this if the city did not amend its medical marijuana ordinance, and we want to respect the local control," Fredericksen said. "Without that ordinance in place we would have lost all control over it."
La Verne Mayor Don Kendrick – a member of the city's Youth and Family Action Committee, which works to combat the problems of substance abuse in the city, among other goals – said he doesn't want marijuana in the community.
"What we have been fighting for years is to make sure the citizens know what marijuana will do to people's lives, and it's not positive," Kendrick said. "I just think we don't want marijuana of any type here. We're going to fight it."
