D.A. Declines To Prosecute Legal Cannabis Users

Riverside County District Attorney Grover Trask won't prosecute people who use marijuana in accordance with state law, even though he supports the federal banning of the drug.

County supervisors voted to prohibit marijuana dispensaries and growing cooperatives in unincorporated areas. Prior to the decision, Trask issued a 10-page report supporting the ban, saying he believes federal law "clearly and unequivocally states that all marijuana related activities are illegal."

Trask said he never intended to prosecute patients.

County Supervisor Jeff Stone, who supports the ban, interpreted Trask's report to mean the D.A. would file charges against anyone alleged to use marijuana for any purposes.

In 1996, California voters decriminalized cannabis for patients who use it with a doctor's recommendation, though possession of the drug for any reason is a federal crime.

Riverside County has since issued 350 medical marijuana identity cards to patients since December.
