FL: Brevard Medical Marijuana Dispensary Rules To Be Devised

With Florida voters approving a constitutional amendment to expand the use of medical marijuana, Brevard County commissioners are preparing to formulate rules for where those marijuana dispensaries can be located.

Commissioners have directed the county's Planning and Development Department to prepare a proposed ordinance to restrict the location of such facilities. Among the options would be restrictions on having medical marijuana dispensaries near single-family residences; near schools, churches, day care facilities or parks where children may frequent; or near pain-management clinics or other medical marijuana dispensaries.

In addition, commissioners asked the Planning and Development Department to include in the proposed ordinance regulation of operational issues, such as establishing limited hours of operation.

"I think we should be proactive in doing something along this line," County Commission Vice Chair Curt Smith said.

The Florida Medical Marijuana Legalization Initiative, also known as Amendment 2, was approved by voters Tuesday, getting 71.29 percent of the vote statewide. The measure needed 60 percent approval for passage. In Brevard County, Amendment 2 received support of 70.84 percent of voters.

Amendment 2 allows medical marijuana to be provided as a treatment for patients with cancer, epilepsy, glaucoma, HIV, AIDS, post-traumatic stress disorder, amyotrophic lateral sclerosis, Crohn's disease, Parkinson's disease and multiple sclerosis. It also will allow licensed physicians to certify patients for medical marijuana use after diagnosing them with some "other debilitating medical conditions of the same kind or class as or comparable to those enumerated."
