Hearing Reset in Medical Marijuana Lawsuit Against City

Billings, MT--A District Court hearing scheduled for Friday in a lawsuit filed against the city of Billings by the owner of a medical marijuana business has been rescheduled.

An attorney for William Reid, who filed the suit and was granted a temporary restraining order against the city last month, asked that the hearing be rescheduled because it will "aid in facilitating potential resolution to this case," according to court documents.

The restraining order, issued by Judge Gregory Todd on July 22, prohibits the city from enforcing an emergency ordinance passed on July 1. The ordinance bans the storefront sales of medical marijuana in Billings.

Reid claims in the lawsuit that the City Council improperly declared an emergency to pass the ban on sales of medical marijuana.

A hearing on whether to make permanent the restraining order issued by Todd has been reset to Sept. 20. The temporary restraining order will remain in place until then, court records state.
