New business license rules could Hercules bar cannabis clubs

HERCULES - The Hercules City Council will vote Tuesday whether to deny a license to any business that violates either federal or state law.

While an accompanying staff report does not mention any specific businesses, the amendment appears to cover medical marijuana dispensaries, also known as cannabis clubs.

California voters in 1996 approved marijuana for medical use on the recommendation of a doctor. But the federal government considers marijuana an illegal drug with no medical use.

City Attorney Mick Cabral could not be reached late Monday.

The new rule, part of an amendment to the Municipal Code, reads: "No license shall be issued . . . authorizing the conduct or continuance of any business which violates state or federal law."

The ordinance passed at a first reading on April 25.

The Council will meet at 7 p.m. at City Hall, 111 Civic Drive, Hercules.
