SACRAMENTO - The remaining portions of a federal civil rights lawsuit
filed against Placer County by medical-marijuana activist Steven Wynn
Kubby over a raid at his home have been dismissed.
Placer officials made the announcement in a press release Friday, saying
that Kubby and his wife, Michele, agreed to the dismissal recently and
that U.S. District Court Judge Morris England signed the order.
The Kubbys, who fled to Canada following Steven Kubby's conviction in 2001
on drug charges in Placer County, received no monetary damages, Placer
officials noted.
A federal judge dismissed most of the lawsuit last year, they noted in the
press release.
Kubby was prosecuted in 1999 on charges of conspiracy and cultivating and
possessing marijuana for sale following a raid on his Olympic Valley home.
A Placer County jury failed to reach a verdict on the charges, but it
found Kubby guilty on a separate count -- felony possession of mescaline
and a psychedelic mushroom.
Kubby never served a 120-day sentence, fleeing to Canada. He is considered
a fugitive by Placer officials.
Kubby has contended that a jail term would be similar to a death sentence
because he would be unable to receive marijuana therapy for adrenal
cancer. He has stated that Canadian officials allow him to use marijuana
to treat his illness.
