Medford Judge Issues Order Allowing Medical Marijuana Dispensary To Stay Open

Oregon - A circuit court judge has issued a stay of the revocation of the business license for MaryJane's Basement, a medical marijuana dispensary in Medford. The stay was issued Wednesday, a few days after the Medford City Council revoked the license. The stay, issued by Judge Timothy Gerking, orders the owners of the dispensary and the city council to craft an order allowing the business to remain open as a retail business but prohibiting the sale or distribution of marijuana until further notice. Gerking said he will review the council's decision and the city will come back before the court on May 7 to argue the merits of its case. Richard Nuckols, co-owner of Mary Jane's Basement/Attic, told the Medford Mail Tribune on Tuesday that the closure will make it hard for his 1,600 some patients to find safe access to marijuana.

Medford is one of several cities in Oregon that have drafted ordinances attempting to ban or restrict medical marijuana dispensaries in the last few months as Oregon was in the process of setting up a medical marijuana registry. The registry became active on March 3. The city took the action last Thursday. The same day it also placed a moratorium on medical marijuana dispensaries within city limits.
