Medical Marijuana Patient Faces 5 Years In Prison!

Medical marijuana patient and caregiver Monica Ginn was denied a medical
marijuana defense by a Thurston County Judge on January 14th. That judge
ordered her released pending appeal, but heartless Corrections Department
Officers took the 53-year-old woman to jail following her publicized trial.

Monica Ginn was convicted unjustly. Physicians and attorneys are watching
this case with shock and disbelief. Now Monica's sentencing date has been
set, and those who support the laws of Washington State are now called upon
to protest this travesty.

Monica Ginn will be sentenced on Thursday, January 30th at 2 PM in the
Thurston County Courthouse. Supporters are encouraged to attend and voice
their support for medical marijuana patients in Washington. Newspaper and
TV reporters are expected, so this is a very important date for all
concerned.

There will be a protest at the sentencing date:

Thursday, January 30th
2 PM at the Olympia Courthouse
2000 Lakeridge Drive SW in Olympia

Directions: take I-5 to exit 104 -- 101 North to Aberdeen. Go 1 half mile,
take the first exit, Crosby, and turn right at light. Take next right
immediately following gas station on corner. Follow signs to Courthouse,
ahead, on left, then right into parking area.) Parking is limited, but
there is extensive shelter out of the rain in front of the entrance to
Building 2. The trial is in room 229 on second floor of Building 2.

LETTER ON MONICA'S CASE FROM WASHINGTON PHYSICIAN FRANCIS PODREBARAC

I have recently become aware of the Monica Ginn case involving medical use
of marijuana. As you may remember, I am one of the physicians who helped
write I-692 (WA State Medical Use Of Marijuana Act of 1998) with Dr. Killian
and others.

I am deeply concerned about the wrongful prosecution of patient, Monica
Ginn, for many reasons. Most importantly, Judge McPhee's ruling to disallow
the medical defense in her case, seems to me to violate I-692 and recent
federal case law. It was not the intent of the law, its authors, nor the
people of WA State to prosecute medical marijuana patients period, let alone
refusing them the medical defense in a court of law. Moreover, a recent
federal 9th Circuit Court ruling let stand by the Supreme Court, makes clear
that physicians can legally recommend medical use of marijuana to patients
in states where such laws exist.

Denying Monica Ginn the medical defense appears to be either prosecutorial
and judicial ignorance of current laws, or willful misconduct by those
involved. After speaking politely with the prosecutor, Jack Jones, twice
today about my concerns in this case, his only response to me was to laugh
and then rudely hang up the phone (both times).
