Medical Marijuana: Too Late For Kingston Moratorium

Massachusetts - The Planning Board will pursue Town Meeting approval of a bylaw siting potential medical marijuana treatment centers in specific parts of town. It has not yet been determined the parts of town where they would be allowed. While medical marijuana has been the subject of several public hearings, the Planning Board will have to start the public process over again when considering a bylaw change, because the hearings were based on a proposed moratorium.

Town Planner Tom Bott said a ruling from the attorney general's office limits the length of time a moratorium can be in effect. Moratoriums cannot extend beyond Dec. 31, 2014. Planning Board member Susan Boyer advocated for a new bylaw instead. "I think it make more sense, given the timeframe," she said.

About a third of the state's cities and towns have enacted temporary moratoriums designed to provide more time to develop new zoning and other regulations. Voters approved these moratoriums at fall town meetings. Kingston doesn't necessarily hold one, and that's the case this year. The Planning Board closed the hearing on medical marijuana and voted to advertise a new public hearing to accept input into creating a bylaw instead.
