Monterey Orders Shutdown of Medical Marijuana Store

California - The City of Monterey has denied a business license for MyCaregiver Inc. and has ordered the medical marijuana dispensary to stop operating immediately.

The City rejected the company's business license application because medical marijuana is not listed as a permitted use under the City's Zoning Ordinance, and any use not named in the City code is not permitted.

In a letter to owner Jhonrico Carr, the City issued a cease and desist order to MyCaregiver Inc. for operating a business without a business license.

The cease and desist order means MyCaregiver, Inc. must shut down immediately or face possible civil and criminal penalties for operating a business without a license.

The owner of the building could also face fines of up to $2,500 a day.

The Monterey City Council will consider a moratorium on medical marijuana facilities within city limits at its meeting at 7 p.m. Jan. 19.

A moratorium would give the Council and City staff time to study the issue and develop a policy dealing specifically with medical marijuana.
