Nevada: City Approves 4th Medical Marijuana Dispensary

The Henderson City Council approved a medical marijuana dispensary Tuesday night that plans to open on Eastern Avenue, south of the 215 Beltway.

The Source Henderson becomes the fourth dispensary approved in the city, three of which are within about two miles of each other.

None have opened yet. Clark County has only one dispensary in business, Euphoria Wellness in the southwest Las Vegas Valley.

Andrew Jolley, the co-owner and CEO of The Source's parent company, said the dispensary plans to apply for building permits in a few weeks and could be open by the new year.

"Our partner owns the shopping center," Jolley told the council with a smile. "That always helps."

The Source, which is owned by Henderson Organic Remedies LLC, originally missed the cut when the state ranked dispensary applicants. It came in sixth, and only five dispensaries were allotted for Henderson.

But another dispensary, Wellness Connection, was forced to withdraw plans to open a dispensary near the Galleria at Sunset mall.

Wellness Connection hadn't gotten proper city approvals before the state OK'd its application last year. So Henderson Organic Remedies went to court, asking a judge to give it the fifth slot and throw out Wellness Connection's provisional state certificate.

The state and Henderson's city attorney didn't fight the request, with the state admitting it had erred in granting approval to Wellness Connection. The city supported Henderson Organic getting state approval so city residents would not be deprived of access to legal medicine.

After initially resisting, Wellness Connection's owners surrendered their state certificate in April.

In July, a Clark County District Court judge ordered the state to give Henderson Organic Remedies a certificate, which it quickly did.

Henderson Organic held a community meeting Aug. 13 in Henderson to gauge public opinion. City records show seven residents showed up, none of whom were opposed to the dispensary.

By law, a medical marijuana dispensary is required to be a mile from any other dispensary and 1,000 feet from a school, public park or public playground.

The same company plans another dispensary called The Source at Sahara Avenue and Rainbow Boulevard in Clark County.
