Recreational Marijuana On Cañon City General Government Committee Agenda

The Ca̱on City General Government Committee will discuss something that communities across the state are talking about Рrecreational marijuana Рwhen it meets for its regular meeting at 4 p.m. today at City Hall, 128 Main St.

By Oct. 1, municipalities must enact a local ordinance unless the governing body of the municipality opts out of retail marijuana pursuant to provisions in Amendment 64. Colorado voters in November passed the amendment, which legalized the possession and use of marijuana and the creation of a regulatory system for retail sales, cultivation, products manufacturing and testing.

City Attorney John Havens will outline three options for council to consider. He said if council chooses to ban recreational marijuana in all of its forms, an ordinance could be done before the Oct. 1 deadline.

"If they are not sure they want to do that, my suggestion is going to be they do a moratorium that would give us a chance to study more thoroughly the state regulations that just came out and determine what we want to do while not missing the constitutional deadline," he said. "The adoption of a moratorium ordinance would satisfy the constitutional requirements."

The third option would be to designate the city clerk or another representative as the authority to receive applications if the state doesn't authorize a timely deal with applications.

"That appears to be unlikely, but it is in the constitution," Havens said. "We would have to do that if we don't ban and we don't adopt a moratorium."

Council also could consider regulations that may or may not include local licensing.

"The state will regulate no matter what unless we ban," he said.
