Ruling Revives Lawsuit Over Marijuana Dispensary Certificate

An appellate court ruling revives a company's lawsuit challenging a state agency's decision to award a certificate for a medical marijuana dispensary in a northern Arizona community to a rival.

The ruling issued Tuesday by the state Court of Appeals said a Maricopa County Superior Court judge wrongly dismissed the suit filed by Compassionate Care Dispensary Inc. against the state Department of Health Services.

The department awarded a certificate to operate a dispensary in Winslow to The Medicine Room LLC through a 2012 lottery, but Compassionate Care contended that The Medicine Room and another applicant weren't in compliance with Winslow's zoning ordinance.

According to the Court of Appeals, Compassionate Care's claims in its suit had enough of a basis to allow it to be considered further in trial court.
