San Leandro Bans Medical Marijuana Dispensaries For One Year

After several motions failed, the City Council has agreed on a one-year ban on medical marijuana dispensaries and cultivation facilities.

Vice Mayor Michael Gregory called the one-year prohibition approved Mondaya compromise. "We have a polarized council on this issue. This not what some of us on one side wanted, and it's not what others on the other side wanted," he said.

The interim measure allows the city to see what the state and federal governments and other cities do about regulating medical marijuana dispensaries in the coming months.

San Leandro has a moratorium on dispensaries and cultivation set to expire at the end of September. On a 6-1 vote, the council on Monday asked the staff to draft an ordinance prohibiting medical marijuana dispensaries until June 30, 2013, with Councilman Jim Prola voting against.

The city staff had recommended a permanent ban. The police department has seized more than 17,627 marijuana plants and 283 pounds of marijuana since 2011. About 85 percent of those were plants grown in San Leandro residential neighborhoods, according to a staff report.

Marijuana cultivation operations are blamed for some fires that have occurred in the city, the most recent in April on Warwick Avenue. Police also say they have seen an increase in marijuana-related crimes.

The city has been studying the question of whether to allow marijuana dispensaries and cultivation facilities since October 2010, when the council first enacted an emergency moratorium. The moratorium was extended twice.
