State Issues Draft Rules For Medical Marijuana Law

The Massachusetts Department of Public Health (DPH) posted draft regulations Friday for implementation of the state's new medical marijuana law.

The draft regulations are available for review at the DPH's medical marijuana website.

The DPH will hold hearings and a public comment period to allow for further public input before the regulations are finalized, the DPH said in a FAQ page on its website. The public comment period will be from March 29-April 20. Public hearings will be held April 19 at 10 a.m. in Plymouth, Boston and Northampton.

Voters approved Ballot Question 3 by 63.3 percent in November 2012, making Massachusetts the 18th state to approve the use of medical marijuana.

The measure became law on Jan. 1, however it requires the state to issue regulations by this May governing how the law will be implemented.

The law allows qualifying patients to obtain and use marijuana with certification from a doctor.

The law also allows the state to register nonprofit medical marijuana dispensaries that will be permitted to grow, process and sell marijuana to qualified patients or their caregivers. However, no medical marijuana dispensaries can open until final regulations in place, the DPH said in a release Friday.
