Transportation Of Medical Marijuana Up For Discussion At Burton Legislative Committee

Officials in Burton are set to discuss an ordinance on the transportation of medical marijuana as dispensaries in the city are adapting to a new policy on the services they can provide.

A 5:30 p.m., Monday, Feb. 18 legislative committee meeting at Burton City Hall, 4303 S. Center Road, has been scheduled to discuss the city instituting its own local ordinance following the approval of House Bill 4856.

The house bill requires anyone transporting medical marijuana to carry it "enclosed in a case that is carried in the trunk of the vehicle" or "enclosed in a case that is not readily accessible from the interior of the vehicle, if the vehicle in which the person is traveling does not have a trunk."

Burton Police Chief has said the local ordinance would not differ from the state bill, but it would allow the department to keep more money from fines in the city and lessen the time officers would have to spend in court in downtown Flint.

The discussion comes on the heels of a Feb. 8 state Supreme Court ruling stating that prohibits patient-to-patient transfers of marijuana at dispensaries as a nuisance violation under the state's public health code.

Dispensaries in Burton were to have received a letter last week telling them to end such services, but officials said they could remain open if they were only providing consulting services.

One such business -- The Barn on East Bristol Road near Center Road -- voluntarily ceased operations immediately following the high court's ruling.
