Upland Considers Fining Medical Marijuana Dispensaries

City officials are reviewing a new approach to battling unwanted medical marijuana dispensaries opening in the city.

Having spent hundreds of thousands of dollars on fighting to close dispensaries, the Police and Fire Committee on Monday will review an administrative policy that would fine a dispensary every day it is in violation of city code.

"We're going to establish administrative fines for non-conforming or violations of the municipal code, which would include land-use violations relating to medical marijuana," City Manager Stephen Dunn said.

"If the council approves it then they'll be fined per day for every day they're out of compliance."

The policy will also apply to other municipal code violations in the city, Dunn said.

"I'm confident that the fees will have a mitigating effect on illegal conduct so I look forward to hearing from the city manger and/or the police committee members on the issue," said Councilman Gino Filippi, who is a member of the committee.

Filippi said he would be concerned that collecting the fees may require court action, which the city would want to avoid, but it's a step in the right direction.

The city's zoning prohibits medical marijuana dispensaries from operating.

The city has taken legal action against several dispensaries over the last couple of years, leading to nearly $500,000 in legal fees.

The most prominent medical marijuana dispensary has been G3 Holistic, which has been in a legal dispute with the city since 2010.

Attorneys representing G3 claim the city is not allowed to ban dispensaries through zoning, while the city believes it can.

The case will be heard by the state Supreme Court.

The Police and Fire Committee will meet at 5 p.m. Monday in the Pinky Alder Room at City Hall, 450 N. Euclid Ave.
