California Supreme Court Strikes Limits for Medical Marijuana Patients

San Francisco, CA -- The California Supreme Court issued a unanimous published decision in People v. Kelly, striking down what it considered unconstitutional legislative limits on how much medical marijuana patients can possess and cultivate.

The decision also affirms protection from arrest and prosecution for patients who both possess a state-issued identification card and comply with state or local personal use guidelines.

"The California Supreme Court did the right thing by abolishing limits on medical marijuana possession and cultivation," said Joe Elford, Chief Counsel with Americans for Safe Access, the country's largest medical marijuana advocacy group. "At the same time, the Court may have left too much discretion to law enforcement in deciding what are reasonable amounts of medicine for patients to possess and cultivate."

Stockton Activists Gather to Discuss Safe Access

Please join Stockton medical marijuana activists for a community meeting on Monday, February 1st. The meeting is organized by LCCSJC - Legitimate Cannabis Coop San Joaquin County (l.c.c. » Home). LCCSJC is a local independent group of medical marijuana activists who want to advance safe, regulated access to medical marijuana in Stockton and San Joaquin County.

California Legal Tip of the Month

It's important to follow the guidelines for the county you are actually in, not just the county in which you live. If you are traveling through another county, or are visiting a dispensary in a different county, you are required to follow that county's laws about plant numbers and the amount of medicine you can possess. If you're unsure about which counties you'll be traveling through, it's best to follow the state minimum, which allows a patient to possess 6 mature (OR 12 immature) plants and 8 oz. of processed medicine. Information about guidelines around the state is available at Local Medical Marijuana Guidelines, though there are some locations that are considering changes to their own guidelines. It might be wise to contact the county to be sure you are in compliance.

Patients often make the mistake of thinking they are bound only by the guidelines of the county they live in, and, in the event of a law enforcement encounter, end up facing charges. Play it safe, and, if you're unsure, stay under the state guidelines.

Matthew Zugsberger is a medical cannabis patient facing state criminal charges in Sacramento, CA. Please show your support during his jury trial for felony possession and transportation of marijuana. Trial is scheduled to begin Monday, February 1st at
8:45 a. m. at the Sacramento County Courthouse, Department 4, 2nd Floor.

Please note that you should not bring medicine into the courthouse. Be prepared to show ID and go through security. Please be respectful. It is often hard to sit and watch injustices unfold in front of you, but interruptions in the courtroom can cause a judge to take his anger out on the defendant. Dress for court. Dress like it is you that is on the stand. As supporters in the courtroom, your appearance reflects on the defendant. TIP: No need to draw attention to yourself, just all stand up and leave with the defendant.

As part of the celebration for Medical Marijuana Week, SF-ASA will host a party on Saturday, February 20th from 2 pm to 7 pm at Dennis Peron's house: 3745 17th Street (between Sanchez and Church Streets) in San Francisco. We will have food and drink and many surprises. A suggested donation of $10 is requested. Come join us for the afternoon and early evening.
