Attorney: Simms Wasn't Smoking Pot

Tennessee Titans quarterback Chris Simms wasn't the one smoking marijuana in his car when he was pulled over in New York, his defense attorney argued Monday.

Simms, 30, the son of former New York Giants quarterback Phil Simms, went on trial in Manhattan Criminal Court Monday on charges of driving under the influence, the New York Daily News reported.

The signal-caller was arrested July 1, 2010, at a sobriety checkpoint along the city's West Side Highway.

Prosecutor Alexandra Glazer said Simms reeked of pot and "admitted smoking marijuana in the car" to the arresting officer.

But defense lawyer Harvey Steinberg said 17-year-veteran officer Francisco Acosta had it wrong, contending it was Simms' backseat passenger who had been smoking in the 2009 Mercedes, the Daily News reported.

Steinberg told the court Simms' friend would testify he was the one who was using drugs.
