YORBA LINDA - The doors apparently have shut – at least temporarily – at Yorba Linda's first marijuana collective after the city determined it was operating in violation of the city's Municipal Code.
Salubrious RX was sent a letter by the city notifying the business of the alleged violation.
The collective opened for business in mid-January at 22607 La Palma Ave., Suite 405, despite a 2006 city code meant to prevent marijuana dispensaries from operating within city limits.
California voters passed Proposition 215 in 1996. It allows marijuana usage for medicinal purposes, which some say supersedes federal laws banning all marijuana use.
Salubrious was listed on its license as a sole proprietorship wellness center operated by Sandy Snell. Nowhere on the license was medical marijuana mentioned.
"We hope to work with the community rather than against it," Snell said on Feb. 9 after the City Council called a special closed-session meeting to discuss the collective. "We hope they will welcome us and the medical-marijuana patients who need us."
The collective is a nonprofit group with a board of directors, and has city, state and county permits, Snell said at the time.
Multiple subsequent phone calls to Snell about the city's recent action were not returned.
After receiving the letter, Snell voluntarily relinquished Salubrius' business license, Yorba Linda City Attorney Sonia Carvalho said. Snell has up to 15 days from the time she received the letter to file a protest with the city.
According to the collective's listing on Weedmaps.com, Salubrious has temporarily shut its doors. A reporter visited the business Friday afternoon and found it closed. The city attorney confirmed that Salubrious is shuttered.
"(A medical marijuana collective) is a use that is prohibited by our Municipal Code," Mayor John Anderson has said. "Our code section is one that has been tested in other parts of the state and upheld."
