NOTICE OF PUBLIC RULE-MAKING HEARING
BEFORE THE COLORADO BOARD OF HEALTH
NOTICE is hereby given pursuant to the provisions of Section 24-4-103, C.R.S., that the Colorado Board of Health will conduct a public rule-making hearing to consider the promulgation of:
Amendments to 5 CCR 1006-2 — Rules and Regulations Pertaining to the Medical Use of Marijuana

Hearing Subjects/Issues Involved/Statutory Authority
The purpose of this hearing is to receive public comments on proposed rules further defining the term "primary care-giver" and clarifying the phrase "significant responsibility for managing the well-being of a patient"; requiring that signatures on Medical Marijuana Registry applications and related forms be notarized; providing parameters for the number of patients to whom a primary care-giver may provide services; requiring compliance with the Colorado Secure and Verifiable Identity Document Act, C.R.S. § 24-72.1-1-101 et seq.; and altering the process for changing a care-giver's listing in the Medical Marijuana Registry. These proposed rules were previously published on February 10, 2009, and the proposed rules filed today are identical.
The proposed rules have been developed by the Center for Health and Environmental Information and Statistics Division of the Colorado Department of Public Health and Environment pursuant to Section 25-1.5-106, C.R.S. These proposed rules were previously filed with the Secretary of State's Office on January 30, 2009. The proposed rules have not changed and have been available for comment since February 10, 2009.

Participation in Public Rule-Making Hearing/Submission of Written Comments
The Board of Health strongly encourages all interested parties to participate in the hearing by providing written data, views, or comments prior to the hearing. At the discretion of the Chair, oral testimony at the hearing may be limited to five minutes or less, depending on the number of persons wishing to comment. Additionally, the Chair may limit duplicative or repetitive testimony.
These proposed rules are the same as those previously published on February 10, 2009. Persons that submitted written comments prior to April 29, 2009 should not resubmit those comments. Written materials not previously provided shall be submitted no later than May 15, 2009 to allow the Board sufficient time to review the comments prior to the meeting. All written comments received since the original February 10, 2009 notice of rulemaking will be provided to the Board for consideration.
