Verdict In California Medical Pot Case Upheld

The conviction and 10-year sentence of a California medical marijuana advocate who grew 32,000 pot plants for patients and fellow Rastafarians has been upheld.

The federal judge who originally sentenced Charles "Eddy" Lepp to prison in 2009 had criticized the federal law mandating a 10-year term for growing 1,000 or more marijuana plants, the San Francisco Chronicle reported Thursday.

However, U.S. District Judge Marilyn Hall Patel of San Francisco said she was bound by the law, and the 9th U.S. Circuit Court of Appeals agreed.

"The statutory minimum sentence is not cruel and unusual punishment," the three-judge panel said.

Federal agents arrested Lepp in 2004 after finding the marijuana plants in gardens near his home in Lake County.

Lepp argued the plants were for patients who had a right to use marijuana under California law, and also said he was a Rastafarian minister, for whom marijuana is a sacrament, and was growing the plants for 2,500 members of his church.

The appeals court upheld Patel's refusal to allow Lepp to invoke a religious defense, saying his prosecution served the government's "compelling interest in preventing diversion of sacramental marijuana to non-religious users."

Lepp's lawyer, Michael Hinckley, who had argued the 10-year sentence was grossly disproportionate to the crimes, said he was disappointed by the appeals court ruling.

"The thought of him spending 10 years in prison, in circumstances like these, is tragic," he said.

Eddy Lepp is a political prisoner of the times. He is no different than a prisoner of war. Amnesty International needs to get involved with his case. My God !!!! TEN YEARS for growing a plant for religious purposes, this country's penalties need to be changed. Most first time felon's get off with a slap on there wrist but not a harmless marijuana grower. This man is a symbol of Passive Resistance much like Ghandi seventy years ago, time really never changes some things. It is with sadness and a heavy heart i send this message to my loved ones we lost my appeal i am shocked they were able to decide it in just a few days when we were sure it would take several mo.s to do so i suspose it proves i am in fact a P.O.W. and that darker forces are at work here however kath (my att.) says to not give up hope as she belives they are in error just as patel was she will file a en blank appeal to to 9th curit panel of judges and failing in that we will go to the supreme court the court went against a supreme court ruleing to do what they did so there is much reason for hope however it will take time to get done kath has not yet told me what we are to do or how long it will take i thank you all for being there for me thru all of this may jah continue to bless us all i love and miss each of you very much again thankyou love respect EDDY
