A medical marijuana business has been approved by the state to operate in Beavercreek, but the city currently has a temporary ban in place against such businesses.
In January, Beavercreek City Council passed a 6-month moratorium against medical marijuana businesses. The temporary measure stops any such business from operating within city limits, but it is set to expire on July 22.
The state announced Monday where medical marijuana dispensaries will be located and who will operate them.
Harvest of Ohio has been approved to operate a dispensary at 4370 Tonawanda Trail in Beavercreek.
Beavercreek City Manager Pete Landrum said council members will need to decide what the next course of action will be.
They have a few options.
Landrum said council could decide to let the moratorium expire and simply allow medical marijuana businesses to operate within the city limits.
Council could also pass a permanent ban on medical marijuana businesses.
Landrum said in the second scenario, council could decide to take legal action in an effort to stop Harvest of Ohio from opening its doors, or allow the one business to operate while preventing any others in the future.
Harvest of Ohio has not submitted its specific plans to the city for approval. Those plans would need to comply with conditional uses that are spelled out in the city’s zoning code and be approved by the city’s planning commission.
