ABUSE OF POWER ALLEGED IN MARIJUANA CASE
Defense Begins Case In Kubby Trial
Allegations of abuse of power were raised Tuesday in the trial of a Northern
California couple accused of growing marijuana.
Steve and Michelle Kubby say that the marijuana was for medicinal use.
As the defense began its case Tuesday, lawyers for the Kubbys said that the
Placer County District Attorney's Office was intentionally ignoring the
voter-approved Prop. 215, and not recognizing the legal right of citizens to
use marijuana for approved medicinal purposes.
"This case is no more about marijuana than the Boston tea party was about
tea," Steve Kubby said.
The Placer County District Attorney's Office has denied the allegations.
The Kubbys face 19 charges of cultivating to sell marijuana.
The defense called two witnesses Tuesday who testified that the Kubbys were
only growing enough marijuana to use for their own afflictions.
The defense is not expected to complete its part of the case until
mid-November.
