California Cannabis Tax Rules Clarified

Retailers selling medical cannabis and derivatives will not collect sales or use taxes from card carrying patients or their caregivers.

Authorities from the State Board of Equalization clarified new tax rules Thursday. Medical marijuana identification cards (MMIC's) will have to be shown to retailers to make purchases tax free. The MMIC's are issued by county public health departments. Cards are valid for the duration of a physician's recommendation, or up to one year.

Exempt products include medical cannabis, medical cannabis concentrate, edible medical cannabis products and topical cannabis.

Sales of recreational marijuana will not start until January 1, 2018. Those sales will be subject to sales tax and an excise tax.

A cultivator tax will also start being collected on the same date.
