California: Medical Marijuana Bills Amended, Ordered For Third Reading

Efforts toward a comprehensive medical marijuana regulatory program continued in the state Legislature on Tuesday, with all three remaining marijuana bills advancing in the legislative process.

Two of the bills – Assembly Bill 243 (Assemblyman Jim Wood) and Assembly Bill 266 (Assemblyman Rob Bonta) – were amended in the Senate to have the majority of their text removed.

In place of the original text are now a few lines of legislative intent summarizing the original purpose of the bills. For the more environmentally-minded AB 243, the amended text now states that the Legislature intends to "establish a dedicated funding source to address environmental damages resulting from illegal cannabis cultivation," and states that the bill can only take effect if AB 266 and the third marijuana bill, North Coast state Sen. Mike McGuire's Senate Bill 643, are approved.

With AB 266 and SB 643 being more broad in their original regulations, AB 266 now reads that the Legislature intends to "enact legislation that would enact a comprehensive regulatory framework for medical marijuana in the state."

On Tuesday, both AB 243 and AB 266 were ordered for a third reading on the Senate floor.

AB 266 is also contingent upon the passage of SB 643.

SB 643 is currently in Assembly. McGuire's District Representative Kerrie Lindecker emailed the Times-Standard that Gov. Jerry Brown's office staff and both houses of the Legislature are working on amendments to the bill.

"Our office is working hard with the Assembly and the administration," Lindecker wrote.

As of its Aug. 18 draft, SB 643 would establish a state licensing structure for medical marijuana industry operators and would set regulations on grow sizes, transportation, supply chains, and medical marijuana products such as edibles. To oversee implementation and enforcement of the regulations, the bill would establish the Office of Medical Marijuana Regulation in the state Business, Consumer Services, and Housing Agency.

A floor vote on the bills is expected later this week. The legislative session ends on Sept. 11.
