CBD Oil Retail Sales Climbing Fast Despite Murky Legal Environment

As more and more states move towards expanded medical marijuana legalization and as the barrier of prohibition disintegrates at an accelerated pace in many states, and despite opposition at the federal level, the market for an extracted cannabis compound called CBD, or cannabidiol is flourishing.

CBD is extracted mostly from industrial hemp and is touted as having a number of potential nutritional benefits as well as possible medicinal applications. Some of this was discussed in depth on a CNN special hosted by Dr. Sanjay Gupta, which helped boost the awareness of the substance. But evidence in the form of properly done peer-reviewed research to support or refute some of the claims has not yet been done. CBD is one of over 80 compounds present within the hemp plant. The best known compound is THC, which comes from cannabis leaves and is the compound that produces a psychoactive response. CBD, on the other hand, does not produce this effect. Yet, because it derives from the same plant there is widespread confusion and controversy concerning its legality. This varies widely from state to state as well as on the federal level. Despite the confusion, sales of CBD oil products are brisk and growing.

Regardless of the confused legality of CBD oil a number of companies sell the substance and deliver it to most states in the United States. Additionally, most of the companies selling CBD oil products, such as the well-publicized Stanley Brothers CW Hemp company, the CBDPure company and a number of other companies are accepting credit cards for CBD oil transactions, so this could be interpreted as a back-door suggestion in favor of the argument that, at least in many circumstances, the substance is viewed as more legal than illegal. But again, the legality is the subject of much debate and the legal issue is far from settled.

Regardless of the legal controversies and issues yet to be resolved, another controversy surrounds the FDA position on the substance. Last year the FDA sent warning letters to numerous companies selling CBD. The reason was due to false claims of medicinal benefits made by a number of the companies contacted by the FDA. The FDA also noted that some of the so-called CBD products contained no CBD, underscoring the need for consumers to be on guard for fraudulent products. Potential CBD oil buyers now must examine a maze of products with confusing ingredients labels, with varying sources of source material for the final product, sort through various CBD oil reviews, and do some good due diligence when trying to choose a reliable authentic CBD product. As the market widens and the laws become clearer this should get easier over time. But, the market is in the emerging stage currently and buyer beware is the order of the day for interested consumers.
