Colorado: Cannabis Bill Could Remove Restrictions On Medical Marijuana In Schools

Medical marijuana could be in schools soon, but even medical marijuana advocates are weary of certain aspects in a bill on Gov. John Hickenlooper's desk.

Right now schools in Colorado have a zero tolerance policy. So kids with valid red cards can't have it at school -- something one Colorado Springs mother learned the hard way.

Jaxon Stormes has Dravet syndrome, which results in limited muscle control and can trigger seizure. The symptoms have lessened, though, since he and his family moved to Colorado.

"He's been on cannabis since 2012, it's successful," said his mother, Jennie.

But Jaxon's treatment led to suspension.

Jennie said after a long work trip, she accidentally packed a lunch with a cannabis pill mixed in. She grabbed his dinner meal container, instead of his lunch container.

She admits it was her mistake, that she never sends his cannabis medication with him to school.

"How can you punish him?" She asked. "He didn't make the lunch, he didn't pack the lunch, I did."

She's fighting the suspension with District 49, hoping the incident won't land on his permanent record. She's not the first parent to run into the issue.

A bill titled Jack's Law is named after another Colorado 14-year-old with cerebral palsy.

He was banned from using his cannabis oil at his Jefferson County school.

Those bans may be changing soon.

"It's not an edict to schools that they have to do this but schools are going to make a choice," said Rep. Jonathan Singer, (D-Longmont).

His bill would allow parents, guardians or school nurses to administer cannabis medications, like prescriptions are administered in schools now.

The bill now sits on Hickenlooper's desk for approval.

"Up until now, it's been zero tolerance at the federal level and at the state level," Singer said. "You're not going to have the Cheech and Chong situation with kids walking around with marijuana and claiming it's medicine."

But Stormes isn't on board with the entire bill. She's worried restrictions written for caregivers, could impact consumers who rely on cannabis medications.
