Florida: Couple Arrested For Alleged Marijuana Grow House Files Lawsuit

A St. Johns County couple was arrested last month for having an alleged marijuana grow operation in their home. They're now suing the St. Johns County Board of Commissioners, saying they want access to their house and clarification of the law.

Scattered outside of Scott Yandell's rented St. John's County home on February 11 were marijuana pants and equipment used to produce marijuana. Deputies say the cannabis they found totaled more than 40 pounds, an amount the Yandells dispute.

"I was under the impression that (under) medical necessity, we had the medical recommendations from a physician and we were allowed self cultivation," said Marsha Yandell.

She and her husband both have documents outlining their medical necessity for medicinal marijuana, as approved by a medical expert.

"What we do know from the other side of this argument is they're stating that it's legal for a licensed medical doctor to write a prescription for medical marijuana," said Chuck Mulligan with the St. John's County Sheriff's Office. "We don't really argue that point. What we don't have is a law that says who can regulate, who can be the distributor, who can become the grower, where can the grow operations exist. At this point in time there is a law however that says you shall not do those things."

The Yandell's filed a lawsuit against the St Johns County Board of Commissioners, and their code enforcement officer on February 27, claiming their home was unlawfully seized during the raid and a proper inspection of the house was never done.

"We've been locked out of our house since Feb 11th," said Scott Yandell. "Unable to return because it was condemned."

The Yandell's were able to briefly return, to gather their belongings. Marsha Yandell says she's filed a complaint with PETA, her pet fish are still inside.

"I would like to see legislation created and a checks and balance system laid out that would prevent this from happening to anybody again," said Scott Yandell.

According to Mulligan, the Yandell's face a list of charges including cultivation and possession with the intent to distribute. Their case is now in the hands of the state attorney's office.

FCN also reached out the St Johns County Board of Commissioners and we were told they could not comment on this pending litigation.
