Hawaii State Bar Association Convention To Focus On Medical Marijuana Dispensaries

Two panel discussions on the new medical marijuana industry will be held Oct. 23 at the Hawaii Convention Center. Sessions are open to the public and also count for continuing legal education credit through the association.

Topics include the legal landscape for medical cannabis in Hawaii, and the legal and operational considerations for medical cannabis dispensaries.

Panelists include Hawaii Department of Health's Medical Marijuana Registry Program Coordinator Scottina Malia Ruis, attorney and founding director of the ACLU's Drug Law Reform Project Graham Boyd, and Hawaii Attorney General Doug Chin.

A recent Hawaii Supreme Court disciplinary board opinion warns Hawaii lawyers against providing legal services to clients seeking to enter the business. While the highest court considers an amendment to that opinion, lawyers may still provide legal advice about Act 241, which established the first statewide medical marijuana retail dispensary system.

Event coordinator Della Au Belatti, state representative and House Committee on Health chairperson, says the pending decision is separate from the conference.

"People are eagerly awaiting to see what the Supreme Court might do, but at the same time, the industry is going forward because of the application of the law," she said. "Whether or not lawyers are advising licensees, they might have other clients with questions raised. Lawyers touch on all aspects impacted by this industry and need to get the up to speed with the issues."
