No Extradition to the USA for Canadian Cannabis Activists!

Please support Canadian citizens Marc Emery, Michelle Rainey and Greg Williams in their fight against extradition to the United States of America.

On July 29th 2005, at the request of the US Justice Department and Drug Enforcement Administration (DEA), Vancouver Police and US agents arrested Marc Emery in Halifax, Nova Scotia and associates Michelle Rainey and Greg Williams in Vancouver, British Columbia. The US filed an extradition request with Canada for these three Canadian citizens and wants them to stand trial in the US for selling cannabis seeds. They each face ten years to life in prison for three "conspiracy" charges.

Marc Emery openly sold cannabis seeds in downtown Vancouver, BC for over a decade to finance peaceful organizations and activities opposed to the US "War on Drugs". Marc Emery contributed $4 million to various organizations in the anti-prohibition movement, and publicly condemned the draconian US Drug War as a horrendous failed policy with disastrous political and social consequences. There were never any objections from the public concerning Marc Emery's activities.

Marc Emery participated in numerous Canadian elections and continues to appear regularly in domestic and international media. The Canadian Government was always well aware of Marc Emery's activities, and Revenue Canada and Revenue BC accepted his "marijuana seed vendor" income tax payments for years. Every issue of Marc Emery's 13-year-old publication Cannabis Culture Magazine is sent to each Member of Parliament, and for 10 of those years the magazine carried his extensive cannabis seed ads. Every Member of Parliament knew what Marc was doing, and never objected at any time.

On May 28th 2007 Marc Emery, Michelle Rainey and Greg Williams will appear in the BC Supreme Court for an extradition hearing scheduled to last for five days. If the judge approves extradition, the Canadian Justice Minister will have the authority to commit Marc Emery, Greg Williams, and Michelle Rainey into US custody. An appeal can be made but will only succeed with the support of the majority of Canadian and American citizens and their elected representatives.

Please help Marc, Michelle and Greg stay in Canada!
Contact the Canadian Justice Minister and politely say

"No Extradition for the BC3!
Keep Marc Emery, Michelle Rainey and Greg Williams in Canada!"

Petition of Opposition to the US Extradition Request for Canadians
Marc Emery, Michelle Rainey and Greg Williams

I Draw the Attention of the Canadian House of Commons In Parliament to the Following:

THAT Marc Emery, well-known political activist and publisher; Michelle Rainey, Leader of the BC Marijuana Party; and Greg Williams, activist and director of Pot.tv, were arrested and jailed on July 29, 2005 at the request of the United States Department of Justice, Attorney General, and Drug Enforcement Administration;

THAT Marc Emery was arrested for activities he openly and honestly pursued for over ten years with the knowledge of the public and all levels of government in both Canada and the United States;

THAT Marc Emery’s activities were tacitly approved by Health Canada’s referral of medicinal marijuana patients to seed banks such as Marc Emery Direct Seeds; and Canada Revenue Agency willingly and knowingly accepted taxes from Marc Emery’s seed sales income;

THAT Marc Emery, Michelle Rainey and Greg Williams face possible imprisonment in federal United States penitentiaries for life without parole, a grossly disproportionate sentence by Canadian standards and one that does not even exist in Canada for murder;

THAT the United States regularly and aggressively imposes unjust and oppressive penalties on persons convicted of marijuana offences, and refuses to recognize medicinal marijuana as an affirmative defense;

THAT the United States’ request for the extradition of Marc Emery, Michelle Rainey and Greg Williams is made for the purpose of prosecuting and punishing them by reason of their political opinion, activity, and involvement, and their open disapproval and condemnation of the United States Drug Enforcement Administration’s practices in America and foreign, sovereign countries;

THAT the United States has chosen to enforce this law against Marc Emery and his associates while ignoring other lower profile Canadians who operate similar marijuana seed-selling businesses without political involvement or influence;

THAT, according to the Extradition Act, the Canadian Minister of Justice “shall” refuse to surrender a person when the surrender would be unjust or oppressive, or when it is requested for the purpose of punishing the political opinions of the person;

THAT “it would shock the conscience” of Canadians to extradite Marc Emery, Michelle Rainey and Greg Williams to the United States of America for activities pursued at all times in Canada; and

THEREFORE, pursuant to the Extradition Act, I call upon Parliament to oppose the extradition of Marc Emery, Michelle Rainey and Greg Williams, and order the Minister of Justice to refuse to issue a surrender order in this case.

Sincerely,
