Judge: Wis. Medical Marijuana Case Should Be Tried

MADISON, Wis. - An appeals court judge has thrown out a marijuana possession charge against an Appleton man who had been authorized to use the drug by a California doctor.

Michael Kettner was cited for possession of marijuana and drug paraphernalia last year after two grams of marijuana and two pipes were found in his car.

Kettner presented a typewritten medical authorization to possess marijuana by a doctor from California, which allows marijuana use for medical purposes, but he was convicted nonetheless.

Appeals Court Judge Michael Hoover on Tuesday upheld the paraphernalia charge but threw out the possession charge.

Hoover says the Town of Grand Chute's marijuana ordinance has an exception for medical use, and there should be a trial on whether Kettner's possession was covered by it.

Good start, when will the rest of the country catch on to this fact: Washington D.C. has been sanctioned by the Federal Government to provide medical marijuana for it's residents. Wake up main stream America!
 
Yeah I am always curious why paraphernalia can even be a charge.

I have been many states where bongs and pipes are openly sold in stores, but many do not want to talk about bud. The guise being the stuff is used for tobacco?

So they find a pipe on a guy, but force the paraphernalia charge? It makes no sense. If the pipe didn't have MJ residue it could be said that it was for tobacco, but since it (presumably) had MJ residue it is paraphernalia. The actual bud charge was tossed, but the residual in the paraphernalia is going to stick?

It is insane. It just shows that the cops and establishment are still trying to use what ever tools they can to oppress a society.
