Lawsuit to Target Colorado Medical Marijuana Bill

Once the House Bill 1284 gets its stamp of approval from Governor Bill Ritter thus making it law, a group of medical marijuana attorneys will file an injunction targeting the new law's specific provisions, stressing how several patients and dispensary owners will be affected by the changes to be implemented.

marijuana dispensaryIt is expected that around half of the total number of medical marijuana dispensaries will be closed down due to the new regulations, leaving owners out of business and patients having to travel longer distances to go to the nearest dispensary.

The lawyers are specifically concerned on 5 provisions: (1) setting a limit of 5 patients on caregivers operating outside the state-sanctioned "center" model, (2) imposing licensing fees on dispensaries reorganizing under the state-guided "wellness center" model, (3) ensuring that only residents of Colorado for at least two years can own dispensaries or wellness centers, (4) not granting licenses to anyone accused or convicted of felony crimes, and (5) giving cities and towns the authority to ban dispensaries.

The bill is very near its finish line. It only needs the House to accept the changes made to it in the Senate and it will head to Governor Bill Ritter's desk for a quick signature to officially make it a law.
