STOCKTON -- The City Council is poised to stop medicinal marijuana stores from popping up in Stockton by imposing a moratorium on permits for them.
"We have to find out more," said Mayor Gary Podesto. "The city wants to find out more."
The council meets today to discuss the issue.
The move comes after a Stockton man applied for a permit to operate a medical marijuana dispensary. The city rejected his request and he later backed away from the whole idea, saying he didn't want to face prosecution by local officials who have vowed to enforce federal law banning the dispensaries.
State law conflicts with the federal rules.
Eight years ago, California voters passed Proposition 215, the Compassionate Use Act, which protects patients and their primary caregivers from prosecution if a doctor prescribes the use of marijuana.
Stockton received one application for a business license to open a medicinal marijuana store, which has been rejected. Bill Pearce's application was denied because the city's zoning code doesn't address the issue, officials said.
Pearce, an Acampo man and president of Blue Mountain Roses Inc., a silk-flower business, could not be reached Friday afternoon.
