Medical Cannabis Organization Brings Counter Suit Against Gov. Brewer

PHOENIX - A new countersuit has just added another layer to the medical marijuana debate playing out in the state.

The owners of the PHX Co-op filed the countersuit Tuesday against Governor Jan Brewer's challenge of Arizona's current medical marijuana law. PHX Co-op says Brewer's lawsuit is an attack on them which threatens to throw them in jail for being in operation.

The marijuana Co-op says they were set up as a safe place for medical marijuana users to meet, trade, learn and smoke without fear of breaking the law.

Even though voters passed a law to allow medical marijuana, it is still illegal for licensed dealers to sell the drug for prescription purposes.

Governor Brewer and Attorney General Tom Horne's filed a lawsuit in May ordering the federal government to clear up confusion they say there is with the law. The medical marijuana law has been on hold ever since.

The Co-op's countersuit seeks to distinguish their clubs from dispensaries that actually sell marijuana. The lawsuit's filers say it would allow them to remain open and operate legally.

U.S. District Court Judge Susan Bolton continues to hear Gov. Brewer's suit.
