Medical Marijuana Bylaw In Works In Milford

The Planning Board at its meeting next week is scheduled to consider a bylaw regulating where medical marijuana treatment centers can be located.

Selectmen had asked the board to create a bylaw shortly after Massachusetts voted in the November election to legalize medical marijuana. That ballot question passed in Milford, 7,514-4,289.

The law authorizes 35 medical marijuana facilities throughout the state.

The Planning Board sent a draft of the bylaw to selectmen, and will continue working on it at its Dec. 11 meeting.

Town Planner Larry Dunkin said the proposed bylaw would restrict medical marijuana treatment centers to two zones in town.

"(The bylaw) seeks to locate such facilities in two industrial zones in town - IB and IC," he said. "Those zones would be along Fortune Boulevard, parts of East Main Street and Beaver and Maple streets as well."

According to the draft, the centers would not be allowed within 200 feet of a "residential zone, dwelling unit, school, place of worship, church, park, playground or youth center." The bylaw states that any lot that has a portion fall within that classification would be unsuitable for such a center.

"Adult entertainment bylaws work in much the same way," he said. "Those are also allowed in those two zones, but require a separation of 400 feet - that didn't seem quite necessary here."

Dunkin said he was concerned about the vague wording of the law allowing medical marijuana.

"The state statute has a fairly expansive definition of a medical marijuana treatment center," he said. "It involves all kinds of stuff. It's more than going to the pharmacy to pick something up - it could include grow facilities."

Selectmen discussed the matter first at a meeting in late December, and indicated an interest in establishing a bylaw before someone looks to open a medical marijuana center.
