MEDICAL MARIJUANA VICTORY IN PLACER COUNTY

FOX News, MSNBC and other media were out in force at the Placer County
DeWitt Center Courthouse and Civic Center, to cover the sentencing hearing
for former Libertarian gubernatorial candidate Steve Kubby.

Attorney J. David Nick, argued on behalf of Kubby that the felony
convictions for a mushroom stem and some tiny cactus buttons were a
misapplication of the law and should be reduced to misdemeanors. Judge John
L. Cosgrove agreed with Nick and also refused to uphold the prosecutors plea
the Kubby not be allowed to use medical marijuana.

Judge Cosgrove also dismissed both cases against Kubby and another Placer
resident, Dr. Michael Baldwin, after the Placer District Attorney filed a
motion saying that Prop. 215 was too vague to be enforced.

No patient utilizing medical cannabis upon a physicians recommendation
should have to go through the terrible anxiety and expense that Kubby and
Baldwin experienced. The costs to both men's lives, families, and
professions are hard to calculate but they are both unwarranted and tragic.
Equally tragic is the expense of pursuing the sick in the perverted name of
the War on Drugs.

We have not heard the last from Placer County. These cases will ripple
throughout the State and indeed the Nation. Prosecutors in nearby Marin,
Sonoma, Shasta, El Dorado, and Sacramento Counties will study this days
events closely. Citizens and Taxpayers will also study this day and will be
far less tolerant of future such prosecutions.

Kubby has called on prosecutors to "Cease and Cure" or in this writers
words, "Moratorium and Dialogue". Either way you put it the time has come
for all concerned, particularly the Attorney General- William Lockyer, to
speak out forcefully on finally insuring the unhindered access of legitimate
patients to medical cannabis. Bill Lockyer has argued Proposition 215 before
the Supreme Court. This welcome and courageous action should be followed
immediately by the creation of a Statewide open dialogue on securing medical
cannabis patient rights while prosecutions cease.
