Mobile Judge Dismisses Lions' Nick Fairley's Second-Degree Marijuana Charge

A misdemeanor charge of possession of marijuana against Nick Fairley was dismissed this morning after the Detroit Lions defensive tackle passed a drug test.

Fairley, in court in his hometown of Mobile, has been tested regularly by the NFL since his arrest in April on the second-degree marijuana charge. After he passed a drug test today, city prosecutors asked for the charge to be dismissed. Mobile Municipal Court Judge Matt Green agreed.

According to a statement from the prosecutor that Green read in court, authorities indicated that they were unsure that they would be able to prove that a pair of partially smoked, hand-rolled marijuana cigarettes in Fairley's car were his. A passenger in the vehicle, Eric Taylor, told police that he would take responsibility for the drugs.

Fairley, 24, dressed in a charcoal gray suit and a white, silk tie, said nothing during his brief court appearance and declined to speak with reporters as he left the courtroom en route to catch an airplane. Today is an off day for the Lions players.

The Mobile police officer who made the arrest told the judge that he had problem with the outcome of the case.

According to police, Fairley's neighbors in the Morningside Manor subdivision off Navco Road reported a white Cadillac Escalade with out-of-state license plates. Several people told police they thought the vehicle was involved in drug activity.

Police stopped the car at about 12:30 p.m. April 3 and searched it after smelling an odor of marijuana.

Police found the marijuana cigarettes in a cup holder and an herb grinder.

Green noted that today's hearing had been delayed once to accommodate Fairley's practice schedule with the Lions, where he is a second-year defensive lineman after being selected in the first round of the 2011 draft.

"When you miss work, it's a little different than when most people miss work," Green said.

The arresting officer told the judge that although the passenger in Fairley's car claimed responsibility for the drugs, he could not tell police exactly what he had found. Police arrested both men.

The marijuana charge came almost two months before an Alabama state trooper reported Fairley's 2010 Cadillac Escalade sped past him about 100 m.p.h. on Interstate 10 on May 27. Fairley is appealing in Mobile County Circuit Court a sentence handed down Sept. 26 in Mobile County District Court, where he was given a six-month suspended jail term, one year of probation and a $600 fine stemming from his May arrest for driving under the influence of alcohol and other charges.
