Public Hearing On Bellingham Washington's Medical Marijuana Regs Slated Tonight

The Board of Health tonight will hold a public hearing to discuss medical marijuana regulations for the town. The three-member board will open the hearing at 7:30 p.m. at the former Town Hall, 4 Mechanic St. Police Chief Gerald Daigle and town attorney Jason Talerman are expected to offer their perspectives on how the town should regulate medical marijuana dispensaries. Growing Health Wellness Center Inc., one of the 158 nonprofit corporations accepted to the second round of the state's competitive licensing process, identified Bellingham as the location for its dispensary. Darya Ghazian-Tafresh, 52, a co-owner, said in September that he had found a possible storefront and had begun negotiations with the landlord.

Also, at least two people representing a nonprofit corporation seeking to open a dispensary have reached out to the town's health agent, Mike Catalano. One was a retired Plainville police officer representing Bio-Care Collaborative Inc., who said he would be speaking at tonight's hearing. In late January, the state will award 35 licenses, permitting only five dispensaries or cultivation centers in each county. So far, the board has reviewed a draft regulation that gives it the power to approve or deny an application for a dispensary. It also can prohibit a dispensary from opening within a half mile of schools, playgrounds and youth sports venues.

During the public hearing, the board could expand on that regulation, possibly proposing an amendment to the state's lengthy list of regulations dealing with security at the dispensaries, a point of concern for Daigle. The hearing will include the review of a plan to prevent the dispensaries from opening anywhere other than the town's industrial areas along Hartford Avenue near Interstate 495. That is being considered as a possible special-use district and would stand in place of the regulation that proposes the buffer zone.
